{"id":634,"date":"2021-03-21T23:51:12","date_gmt":"2021-03-21T23:51:12","guid":{"rendered":"https:\/\/insight.thomsonreuters.com\/sea\/legal\/posts\/the-future-for-lawyers"},"modified":"2021-03-22T02:04:49","modified_gmt":"2021-03-22T02:04:49","slug":"the-future-for-lawyers","status":"publish","type":"post","link":"https:\/\/insight.thomsonreuters.com\/sea\/legal\/posts\/the-future-for-lawyers","title":{"rendered":"The future for lawyers:\u202fLegal service in a cart?\u202f\u202f"},"content":{"rendered":"\n<h4 class=\"wp-block-heading\">\u201cWe&#8217;re in an era of fundamental, irreversible change in the way that lawyers work.\u202fWe have to think deeply about our future, rather than thinking tomorrow will be a better version of today,\u201d\u202fcame\u202fthis\u202fsober\u202fwake-up call from\u202fProfessor Richard Susskind\u202fOBE,\u202fPresident\u202fof the\u202fSociety of Computers &amp; Law in the\u202fUK\u202fat a recent conference.\u202f&nbsp;<\/h4>\n\n\n\n<p>With pressures\u202ffrom clients to reduce their\u202fuse of lawyers, and\u202flaw\u202ffirms under pressure to\u202fboth\u202f<a rel=\"noreferrer noopener\" href=\"https:\/\/insight.thomsonreuters.com.au\/legal\/posts\/whats-keeping-gcs-up-at-night-in-the-asia-region\" target=\"_blank\">add value<\/a>\u202fand\u202freduce their own headcount\u202f\u2013\u202fwhile the need for legal and compliance work escalates\u202f\u2013\u202flittle wonder\u202fthat\u202fthe innovation that technology offers\u202fis a\u202ftantalising\u202foption\u202fand increasingly taking\u202fcentre\u202fstage.\u202f&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>If you can\u2019t beat them, join\u202fthem<\/strong>\u202f&nbsp;<\/h2>\n\n\n\n<p>So,\u202fwhat shape will the future take? The good news according to\u202fRichard, speaking ahead of his Opening International Keynote Address at\u202fChilli\u202fIQ\u2019s Managing Partners Forum on Friday 5 March\u202fis\u202fnot that traditional legal skills won\u2019t be needed.\u202fBut there is bad news:\u202fthey\u2019ll be needed less.\u202f\u202f&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201cThere won&#8217;t be enough work to keep all traditional lawyers in practice, because the market will have moved to different ways of solving problems.\u201d\u202f&nbsp;<\/p><cite>&#8211; Professor Richard Susskind\u202fOBE,\u202fPresident\u202fof the\u202fSociety of Computers &amp; Law in the\u202fUK<\/cite><\/blockquote>\n\n\n\n<p>And these new solutions will flip the\u202flegal\u202fprofession on its head.\u202f\u202f&nbsp;<\/p>\n\n\n\n<p>\u201cWe&#8217;re going to move from legal services or\u202fa\u202fkind of human bespoke service, to legal service\u202fin a cart,\u201d says\u202fRichard, setting the scene for the cataclysm to come.\u202f\u202f&nbsp;<\/p>\n\n\n\n<p>\u201cThe\u202fbig thing is that we will move away from advisory services\u202fto offering solutions\u202fand\u202fproducts,\u202fthat will be available\u202fonline\u202f\u2013\u202fand\u202fthat&#8217;s a huge difference. You\u202fwon&#8217;t go to a lawyer to have\u202fa\u202fdocument drafted, but you\u2019ll\u202flicense the use of their system, which will generate a very reliable draft.\u201d\u202f&nbsp;<\/p>\n\n\n\n<p>There\u2019s no use fighting\u202fthis surge of change by trying to compete with machines, because, as Richard warns,\u202fthey will, in time outperform\u202fyou. In most\u202fcases anyway.\u202f\u202f&nbsp;<\/p>\n\n\n\n<p>\u201cThe exciting opportunity here is to reframe what one does within the legal world and be involved in building the systems that replace our old ways of working.\u201d\u202f\u202f&nbsp;<\/p>\n\n\n\n<p>Although\u202fRichard\u202fforesees a role\u202fin the future\u202ffor the traditional \u201cempathetic trusted adviser\u201d, that person\u202fmay\u202for may\u202fnot be a lawyer, just like\u202fa host of other\u202f\u201cspecial roles\u201d\u202fsuch as\u202flegal knowledge engineers,\u202frisk managers\u202fand\u202flegal technologists\u202fwho\u2019ll be populating the firms of the future.\u202f&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Universities\u202fto do\u202fcatch-up<\/strong>\u202f&nbsp;<\/h2>\n\n\n\n<p>But\u202fmost law schools seem blind to this\u202fcharging Behemoth,\u202fwith\u202fcurricula that\u202fwill need to adapt\u202fto\u202fstart generating 21<sup>st<\/sup>\u202fcentury law graduates he\u202fsays.\u202f\u201cWe need to extend the range of skills that lawyers have\u202f\u2013\u202fand that particularly involves a whole range of technological skills.\u201d\u202f&nbsp;<\/p>\n\n\n\n<p>A\u202fgood legal business in the future,\u202fhe forecasts,\u202fwill provide a blend of human service and technology service,\u202ffocused on\u202f<a href=\"https:\/\/insight.thomsonreuters.com.au\/legal\/posts\/expanding-your-law-firms-tech-function-to-support-business\" target=\"_blank\" rel=\"noreferrer noopener\">meeting the needs of clients<\/a>\u202fusing the best available\u202flegal tech\u202ftools.\u202f\u202f&nbsp;<\/p>\n\n\n\n<p>\u201cIt&#8217;ll be\u202fa blend of human being and machine,\u202foperating a different business model\u202ftogether.\u201d\u202f&nbsp;<\/p>\n\n\n\n<p>That blend will\u202falso\u202fcontinue to\u202fshape\u202fthe charging model, with fixed fees for the automated work,\u202fand\u202fwith a tick to\u202fthe past, \u201cthe billable hour\u202fwill\u202fcontinue to be a sensible way of charging for the traditional expert, when they&#8217;re working on complex work\u201d.\u202f<\/p>\n\n\n\n<p>What will that complex work be?\u202fThat according to\u202fRichard\u202fis \u201cthe biggest question of all\u201d.\u202f&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The future is\u202fnow<\/strong>\u202f&nbsp;<\/h2>\n\n\n\n<p>Although we have&nbsp;some&nbsp;time to&nbsp;transform,&nbsp;we don\u2019t have a lot.&nbsp;\u201cI think most of the claims being made about AI, and its short-term impact on lawyers hugely overstate its impact,\u201d says Richard.&nbsp;\u201cMy bigger point is, though, that most of the long-term claims hugely&nbsp;<em>understate<\/em>&nbsp;its impact.\u201d&nbsp;<\/p>\n\n\n\n<p>At&nbsp;PwC,&nbsp;they\u2019re ahead of the curve,&nbsp;with&nbsp;digital transformation well underway, thanks to the pandemic.&nbsp;\u201cThe speed with which we all shifted to remote working and became entirely dependent on technology to communicate and deliver service really converted a lot of the skeptics,\u201d&nbsp;reveals&nbsp;Tony O\u2019Malley,&nbsp;PwC\u2019s&nbsp;Global Head of Legal Services.&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201cMany in-house lawyers, and in-house teams now see transformation as not just a possibility, but actually inevitable.&nbsp;We\u2019ve seen, particularly through our&nbsp;New&nbsp;Law team,&nbsp;a surge in the appetite for real transformation.&#8221;<\/p><cite>&#8211; Tony O\u2019Malley,&nbsp;Global Head of Legal Services, PwC<\/cite><\/blockquote>\n\n\n\n<p>\u201cSome of it is about cost reduction. But not all of it. Some of it is about setting up their systems so they can access data that helps them run and drive change in the business.\u201d&nbsp;<\/p>\n\n\n\n<p>Use of data analytics&nbsp;is now mainstream and provides valuable metrics for&nbsp;gauging&nbsp;the performance for legal teams.&nbsp; It has&nbsp;also&nbsp;empowered them to&nbsp;prove&nbsp;the value of their work to the business,&nbsp;as a return on&nbsp;investment, explained&nbsp;Tony&nbsp;at the&nbsp;Managing Partners Forum.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Technology&nbsp;to do the heavy&nbsp;lifting<\/strong>&nbsp;<\/h2>\n\n\n\n<p>Then there\u2019s the&nbsp;organisational&nbsp;layer of technology transformation&nbsp;he cited,&nbsp;underpinning the move from siloed business units&nbsp;into broader functional teams.&nbsp;Plus&nbsp;the use of technology to free up lawyers\u2019 time&nbsp;to spend on&nbsp;higher-value,&nbsp;higher-risk issues.&nbsp;<\/p>\n\n\n\n<p>\u201cHigh volume, low complexity work lends itself to automation, or some form of labor arbitrage. A mixture of,&nbsp;and some form of,&nbsp;process engineering,&nbsp;and&nbsp;process mapping. You know, it makes sense to start there. Because often, it&#8217;s the biggest saving, and it&#8217;s the easiest win for you.\u201d&nbsp;<\/p>\n\n\n\n<p>Bill Reid,&nbsp;Chief Legal Officer at Woolworths,&nbsp;is only too familiar with the benefits of&nbsp;technology&nbsp;with&nbsp;the business undergoing an enterprise-wide&nbsp;digital and e-commerce transformation to improve transactions with its customers and suppliers.&nbsp;&nbsp;<\/p>\n\n\n\n<p>Reflecting on&nbsp;the future for lawyers,&nbsp;he has the final word. \u201cTheir&nbsp;low-value,&nbsp;high volume, repeatable work will become increasingly&nbsp;automated.
